Privacy – What that means for you
The Vacationer agrees that Luxury Lifestyle Management (LLM) is not responsible for the accuracy of any information provided to the Vacationer by the Property Owner; and LLM specifically disclaims any and all liability arising from the inaccuracy of such information. LLM is not responsible for any materials provided to the Vacationer or posted on the Site by a Property Owner or Manager. All Property listings on the Site are submitted by the Property Owner or Manager, and although we do have strict listing policies, the information is always collected and submitted by Property Owner or Manager and LLC specifically disclaims any and all liability arising from the alleged accuracy of the listings, property reviews, guest book entries, or any alleged breaches of contract on a Property Owner’s or Manager’s part. Any breach of agreement must be directed to the Property Owner or Manager, regardless of whether booking was made through an LLM owned and operated site.
IN NO EVENT WILL THE SITE, LLM, LLM’S AFFILIATE COMPANIES AND THEIR RESPECTIVE OFFICERS, DIRECTORS AND/OR EMPLOYEES (COLLECTIVELY, “LLM”) BE LIABLE FOR ANY LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM OUR SITE, THESE TERMS, VACATIONER’S USE OF THE SITE AND/OR ANY TRANSACTION BETWEEN THE VACATIONER AND PROPERTY OWNERS, EVEN IF LLM HAS BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) STRICT LIABILITY, (4) TORT, (5) NEGLIGENCE, OR (6) ANY OTHER CAUSE OF ACTION, TO THE MAXIMUM EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. IN ANY AND ALL EVENTS, LLM’S LIABILITY IN ANY CIRCUMSTANCE ARISING OUT OF OR IN CONNECTION WITH THE SITE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES RECEIVED BY LLM’S FOR ITS SERVICES ON BEHALF OF THE VACATIONER, AND (B) $100.00 IN THE AGGREGATE.
THE SITE, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SITE, IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMISSIBLE BY LAW, LLM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE content ON THE SITE OR THE MATERIALS, INFORMATION AND FUNCTIONS MADE ACCESSIBLE BY THE SOFTWARE USED ON OR ACCESSED THROUGH THE SITE, FOR ANY PRODUCTS OR SERVICES OR HYPERTEXT LINKS TO THIRD PARTIES OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE SITE OR ANY LINKED SITE. THE VACATIONER ACKNOWLEDGES THAT ANY TRANSMISSION TO AND FROM THIS SITE IS NOT CONFIDENTIAL AND THE VACATIONER’S COMMUNICATIONS MAY BE READ OR INTERCEPTED BY OTHERS. THE VACATIONER ACKNOWLEDGES THAT BY SUBMITTING COMMUNICATIONS TO LLM AND BY POSTING INFORMATION ON THE SITE, NO CONFIDENTIAL, FIDUCIARY, CONTRACTUALLY IMPLIED OR OTHER RELATIONSHIP IS CREATED BETWEEN THE VACATIONER AND LLM OTHER THAN PURSUANT TO THESE TERMS.
THE VACATIONER AGREES TO INDEMNIFY, DEFEND AND HOLD THE SITE AND LLM (COLLECTIVELY, THE "INDEMNIFIED PARTIES") HARMLESS FROM AND AGAINST ANY AND ALL LIABILITY AND COSTS INCURRED BY THE INDEMNIFIED PARTIES IN CONNECTION WITH ANY CLAIM ARISING OUT OF THE VACATIONER’S USE OF THE SITE (INCLUDING, WITHOUT LIMITATION, ANY DISPUTE BETWEEN THE VACATIONER AND THE PROPERTY OWNER), ANY CONTENT POSTED BY YOU TO THE SITE OR ANY BREACH BY YOU OF THESE TERMS INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS’ FEES AND COSTS. THE VACATIONER AGREES TO COOPERATE AS FULLY AS REASONABLY REQUIRED IN THE DEFENSE OF ANY CLAIM AGAINST LLM FOR WHICH INDEMNITY IS SOUGHT. LLM RESERVES THE RIGHT, AT OUR OWN EXPENSE, TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF ANY MATTER OTHERWISE SUBJECT TO INDEMNIFICATION BY THE VACATIONER AND THE VACATIONER SHALL NOT IN ANY EVENT SETTLE ANY MATTER WITHOUT OUR WRITTEN CONSENT.
In the event any portion of these Terms shall be determined void or unenforceable, the remaining provisions shall continue in full force and effect.
A waiver of any breach or violation of any term, provision, agreement, covenant or condition herein shall not be deemed to be a continuing waiver or waiver of any future or past breach or violation. The Vacationer agrees that all matters governed by these Terms shall be construed under Florida law and that any legal action related to matters governed by these terms shall be brought in Miami-Dade County, Florida. The non-prevailing party in any such action shall pay the costs, including reasonable attorneys’ fees incurred by the prevailing party in any such action.
These Terms embody the entire agreement and understanding between the Vacationer and LLM relating to the subject matter hereof and supersedes all prior proposals, negotiations, agreements and understandings relating to such subject matter. No modification or waiver of these Terms shall be valid unless made in writing and signed by an authorized representative of LLM. LLM reserves the right to change these Terms from time to time.
BY UTILIZING AND AGREEING TO THE TERMS OF THIS SITE BY INITIATING CONTACT, AS AN ADULT OF 18 YEARS OR OLDER, YOU ARE TAKING FULL RESPONSIBILITY FOR YOUR BOOKING. PAYMENTS ARE MADE VIA THE LLM OFFICE, HOWEVER DAMAGE DEPOSITS ARE SENT TO HOME OWNERS FOR HOLDING AND NOT DEPOSITED INTO THE LLM OPERATING ACCOUNT. WE DO NOT HOLD FUNDS IN TRUST AS WELL OUR ACCOUNT IS NON INTEREST BEARING. WE DO NOT COLLECT ANY FEES FOR BALANCES HELD NOR DO WE GET ADDITIONAL SERVICES OR PERKS FOR KEEPING YOUR FUNDS HELD IN OUR OPERATING ACCOUNT. ONCE A DEPOSIT HAS BEEN MADE AND CLEARS THE OWNER SHALL RECEIVE THE MONIES (MINUS ANY LLM FEES OWNER PAYS TO OUR OFFICES) FOR ANY BOOKING MADE THROUGH OUR SITES.

YOU MAY SEE THE SAME HOME LISTED ON VARIOUS SITES NOT ASSOCIATED WITH LLM IN OWNERSHIP BUT IN THE CAPACITY OF MARKETING SITE OR LISTING SITE. LLM ACTS IN ACCORDANCE WITH ANY OTHER SITE AS THEY DEEM FIT, AS WELL AS OUR PARTNERS. PARTNER SITES MAY LIST OUR HOMES WITH SAME PHOTOS AND INFORMATION AS WELL THEY WILL REQUIRE YOU COMPLETE THEIR DOCUMENTATION AS WELL AS OURS. AS WELL LLM HAS PUT ITSELF AND ITS OWNERS THROUGH A BACKGROUND CHECK WHICH CAN BE FOUND ON VERFIED, A SECURITY COMPANY. THE STAMP IS FOUND ON OUR SITES ALONG WITH THEIR LINK TO VERIFY.
ALL BOOKINGS MADE ARE NON-REFUNDABLE. WE WILL MAKE OUR BEST ATTEMPT AT HAVING OUR OWNERS AND MANAGERS RE-BOOK YOUR DATES, IT IS ALWAYS IMPORTANT THAT YOU TAKE OUT TRAVELERS INSURANCE, WE CURRENTLY UTILIZE CSA FOR USA BOOKINGS AND TRAVELINSURED FOR DOMESTIC AND INTERNATIONAL. IN THE CASE OF HURRICANES, TYPHOONS, OR NATURAL DISASTERS DURING YOUR STAY: WE CANNOT CONTROL THE WEATHER AND YOU MUST UNDERSTAND WHEN TRAVELING DURING A HIGH ALERT WEATHER PATTERN, YOU TAKE A RISK OF LOSING ALL OR PART OF YOUR TRAVEL TIME PAID FOR. THE TRAVEL INSURANCE DOES COVER THIS TYPE OF LOSS, HOWEVER WE WILL ALSO ATTEMPT TO HAVE THE OWNER OR MANAGER RE-BOOKS YOUR DATES IF POSSIBLE.
IF HOUSE IS DESTROYED FROM FIRE OR OTHER, YOUR INSURANCE POLICY ALSO COVERS THIS TPYE OF LOSS AND WE STRONGLY RECOMMEND YOU UTILIZE THIS. IF THERE IS A FIRE OR OTHERWISE WE WILL MAKE EVERY EFFORT TO SEE THAT OTHER ACCOMMODATIONS CAN BE FOUND, WHICH MAY BE AT YOUR EXPENSE, HOWEVER WE WILL ATTEMPT TO HAVE THE OWNER OR MANAGER PAY FOR “OTHER” ACCOMMODATION.
IF BY CHANCE THE HOME AREA HAS BEEN RE-ZONED AND OR IS UNABLE TO RENT, WE WILL MAKE EVERY EFFORT TO RE-CONFIRM YOUR BOOKING THROUGH ANOTHER OWNER OR MANAGER. SUITABLE ACCOMMODATIONS OF SAME OR BETTER ARE TYPICAL, BUT SOMETIMES DURING BUSY SEASON THIS IS IMPOSSIBLE. THESE ARE RARE AND UNFORSEEN CIRCUMSTANCES, WE ARE HOWEVER COMPELLED TO DISCLOSE THEM.
FRAUD & TRACKING
BE WEARY OF HOMES FOUND ON OTHER SITES THAT ARE SIMILAR AND PRICED SIGNIFICANTLY LOWER THAN LLM. THERE ARE FRAUDULENTLY SITES AND LISTINGS THAT ARE SEEN CONTINUOULSY ONLINE, THOSE LISTINGS ARE TYPICALLY INCLUSIVE OF PHONE NUMBER AND PAYMENT OPTIONS. THEY WILL ASK THAT YOU PAY IN ADVANCE IN FULL AND THE AMOUNT WILL BE SO LOW THAT YOU WILL BE COMPELLED TO SEND FUNDS, REGARLESS OF METHOD. JUST BECAUSE YOU SEND YOUR PAYMENTS VIA CC DOES NOT MEAN YOU ARE COVERED. MANY TIMES FRAUD SITES EXPECT YOU TO PAY VIA CC AND THEY WILL IN TURN OPEN AND CLOSE MULTIPLE ACCOUNTS TO DRAW OUT FUNDS COLLECTED BY YOUR CC. We represent homes all over the world, and maintain an on-line booking format, we operate by also maintaining a neutral relationship between the Owner and our client. You may walk into our office at any time to sit with a representative to select your house/villa or plan your event. The bookings are made through LLM, and owners or managers or resorts are paid after your payment is accepted through LLM and all forms completed and returned by you.
Many of our homes do not allow parties or events; many of our homes are pet friendly while others are not.
Most homes have a check in from 12pm-4pm and most have a check out of 10am-11am to allow for turnover. Self-catered homes mean that you will not have any daily maid or service during your stay and they may require self-check in. A catered or serviced homes means you will have assistance during your stay, a concierge, a chef or maid (not always) but for the most part, and a manager to help you get organized. All resort villas will have staff and concierge on hand to help you day to day.
Smoking is typically not allowed in most homes, however if there is a policy for smoking they require it to be outside only. There is no house with allowances for indoor smoking, it is prohibited. You may lose your security deposit in full if you decide to smoke inside.
The pools in most homes are heated (optional) when available in most countries, however in Europe and other regions, during the winter season, the pools may be closed down and not open to the public. There is no way to avoid this. Additional pool charges may apply to all homes offering pool heating or spa heating options.
Exit cleaning fees are collected on many homes – these are fees to clean the house after you leave. If you have an excess of cleaning, this may be charged against your security deposit. Any trash not emptied and needing to be removed, excess bottles, excess mess, will be charged in addition to cleaning fees paid. Owners or managers have a right to collect and will let you know upon check out or shortly thereafter.
Damage deposits are typically collected with final payment by check, wire or credit card hold. Some owners will accept this upon arrival. These deposits will be returned after a check of the house is made, all items and electric bills and other utilities and/or television paid viewings will be calculated. If you are at a resort this may also mean that calculations for additional excursions will be added as well. Please note you have been made aware it can take 30-45 days to return your deposit depending on these bills. As well if there are damages exceeding your deposit, the owner has the right to collect via credit card or direct billing for additional damages.
We do not allow parties or loud intrusive gatherings at homes in residential areas not setup for this kind of function. If you are found to have an party or event or gathering without prior consent or authorization you will be asked to leave, no questions asked. You will also lose all monies collected and no refund shall be made.
We do not allow spring break holidays of teens or children wanting to utilize the house for unsupervised stays or parties. These homes are not for use of spring break to keep with the integrity of the homes, location, and complaints. We value relationships. We can however recommend resorts and hotels for this type of event, so feel free to let your villa specialist know so we can assist.
